Extended Producer Responsibility for Manufacturers

A manufacturer becomes an EPR obligated entity because of what it puts on the market (packaging, an electronic product, a battery, a tyre) and each regime has its own CPCB portal registration, its own annual return and its own recycling targets to be met with purchased certificates.

What this means for industrial & manufacturing

Extended Producer Responsibility is not one rule. Plastic packaging obligations arise under the Plastic Waste Management Rules 2016 and the EPR guidelines that sit under them; electrical and electronic products fall under the E-Waste (Management) Rules 2022; batteries under the Battery Waste Management Rules 2022; and waste tyres under the hazardous waste regime as amended. A single manufacturing company can be obligated under more than one at the same time: a firm that makes an electrical product, ships it in plastic packaging and imports batteries for it is registered three times over. Each regime works on the same skeleton: register on the CPCB portal as producer, importer or brand owner, declare what was placed on the market in the relevant year, meet a recycling or end-of-life target that steps up over time, discharge it by obtaining certificates from registered recyclers through the portal, and file an annual return that reconciles the two. The obligations follow the market activity, not the factory gate, which is why manufacturers frequently discover them late.

How KIPL runs it

KIPL establishes which regimes actually bite, which is where most of the value is: the applicability analysis on product category, packaging type and import position is the step that decides everything downstream, and getting it wrong means either an unregistered obligation or a registration the company did not need. From there we handle registration on the CPCB portal, build the quantity computation from despatch and procurement records so the declared figure can be defended, track the target against certificates actually procured from registered recyclers, and file the annual return in time. The exposures are real: an unregistered obligated entity, a target shortfall carried into the next year, or certificates bought from an entity whose registration does not stand up. We also keep the EPR position consistent with the unit's consent and hazardous waste filings, because these are read together.

  • PWM 2016

    Plastic packaging EPR

Producers, importers and brand owners of plastic packaging register on the CPCB portal, carry category-wise recycling and reuse targets, and discharge them through certificates from registered recyclers.

  • E-Waste 2022

    Electrical and electronic products

The E-Waste (Management) Rules 2022 place end-of-life targets on producers of listed electrical and electronic equipment, with registration and annual returns on the same central portal.

  • BWM 2022

    Batteries and tyres

The Battery Waste Management Rules 2022 and the waste tyre provisions under the hazardous waste regime create separate registrations, so a single company can be obligated under several regimes at once.

What you receive

Written for industrial & manufacturing, not adapted from a template.

  • 01Applicability analysis across plastic packaging, e-waste, battery and tyre regimes for the company's actual products, packaging and imports
  • 02CPCB portal registration as producer, importer or brand owner for each applicable regime, with documentation pack
  • 03Quantity computation built from despatch, procurement and import records so declared figures are defensible
  • 04Target tracker mapping the year's obligation to certificates procured, by category, with the registered recycler counterparty recorded
  • 05Annual return filing on the portal, reconciled to the quantity computation and to the certificates held
  • 06Consistency check against the unit's consent, hazardous waste and Form-V filings, and a carry-forward position where a shortfall exists

Questions from industrial & manufacturing

What industrial & manufacturing ask before appointing us.

Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.

How do we know whether EPR applies to us at all?

It follows what you place on the market rather than what you manufacture on site. If your product falls within a listed e-waste category, if you ship goods in plastic packaging as a brand owner, if you import or supply batteries, or if you deal in tyres, an obligation is likely. The applicability analysis has to be done product by product and packaging type by packaging type, because a company is often obligated under one regime and not another.

Can one company be registered under multiple EPR regimes?

Yes, and it is common. A manufacturer of an electrical product that ships in plastic packaging and includes a battery is potentially obligated under three separate sets of rules, each with its own registration, its own targets and its own annual return. They are not interchangeable, and meeting one does not reduce the others.

What actually discharges the target?

Certificates generated by registered recyclers on the CPCB portal and transferred against your registration, in the categories your obligation is expressed in. Buying certificates in the wrong category does not discharge the obligation, and certificates from an entity whose registration is not in order are a risk you carry, not the seller. The tracker should record category and counterparty, not just a total.

What happens if we miss a target or file late?

The shortfall does not disappear: it is carried and pursued, and the regime provides for environmental compensation for non-compliance, with the registration itself at risk in serious cases. A late or unfiled return also leaves the company visible as non-compliant on a central portal, which is increasingly something customers and lenders check independently of the regulator.

Does EPR interact with our MPCB consent?

They are separate regimes with a shared factual base. Your consent and hazardous waste filings describe what the plant generates and ships; the EPR return describes what the company placed on the market. They are read together by auditors and by customers doing supplier diligence, and figures that do not reconcile across them are a straightforward finding.

We supply to a listed customer who is asking for our EPR registration. Why?

Because their own reporting and supplier diligence now reaches into the value chain. A customer with BRSR obligations, or one managing its own EPR exposure, will ask for your registration number and return status as a condition of continuing supply. That commercial pressure often arrives before any regulatory notice does, and it is a common reason manufacturers regularise their EPR position.
