EPR Annual Returns: the yearly filing that closes a compliance year on the portal.

An EPR registration is not compliance by itself. The compliance year is closed by filing returns on the CPCB portal that reconcile the quantity placed on the market against the EPR certificates used to discharge the target.

What it is

Every EPR stream requires the obligated entity to file periodic returns on the centralised portal, in the forms prescribed by the applicable rules, declaring the quantity placed on the market for the year, the target that follows from it, and the certificates mapped against that target. For most streams the annual return for a financial year falls due in the months following its close, and some entities, waste processors and recyclers in particular, file at quarterly intervals as well. The return is the record the authority audits, and the declared quantity in it drives the following year's obligation.

KIPL prepares returns from source data rather than from last year's return: sales, dispatch, import and procurement records reconciled to the quantity being declared, certificate holdings verified against the portal, and any shortfall identified before filing rather than after. Where past returns are inconsistent with the underlying records, we address the discrepancy deliberately, since an unexplained change in declared quantity between years is exactly what draws scrutiny.

Straight answers

Annual Returns: common questions.

01When are EPR annual returns due?

For the main streams the annual return for a financial year is due in the months following its close, commonly by the end of June for plastic and e-waste, with the exact date and form set by the rules governing each stream. Some categories of entity, particularly waste processors and recyclers, also file quarterly. Because the dates differ by stream, an entity obligated in more than one runs more than one calendar.

02What is the difference between registration and the annual return?

Registration is the one-time entry onto the portal that establishes an entity as obligated and defines its categories; the annual return is the yearly declaration of quantities, targets and fulfilment against that registration. Holding a valid registration while failing to file returns is not compliance. The return is where the obligation is actually accounted for.

03What has to be reconciled before filing?

The quantity declared as placed on the market must trace back to sales, dispatch, import and procurement records; the target must follow correctly from that quantity and the prescribed percentage; and the certificates mapped must be valid, of the right category, and actually held on the portal. A return that cannot be reconstructed from primary records is the weakest point in any EPR position.

04What if the return reveals a shortfall?

It is better to know before filing than after. The remedy is to acquire the certificates needed to close the gap where they can be sourced in time; where they cannot, the shortfall attracts environmental compensation and carries forward into the following year's obligation. Either way it is a planned position rather than a surprise, which is the practical argument for reconciling well before the due date.

05Can a return be revised?

The portal's treatment of revisions varies by stream and by the stage of the compliance cycle, and a revision naturally invites scrutiny of why the original figure was wrong. The workable discipline is to get the first filing right from reconciled data, rather than to rely on correcting it later.

06Who files if a producer sells across several states?

The obligated entity files, through the registration it holds. Where an entity operates in more than one state it registers centrally with CPCB and files against that registration; a single-state entity files against its state-level registration. The filing follows the registration, so getting the registering authority right at the outset determines the return route too.

07Are the returns audited?

They are subject to verification and audit by the pollution control authorities, who may seek the underlying records supporting declared quantities and certificate use. Certificates can also be scrutinised at source through the recycler's own filings, which is why certificates acquired from entities whose processing capacity cannot bear them are a real exposure for the buyer.

08What happens to the return data afterwards?

It carries forward. Declared quantities feed the target calculation for subsequent years, so a figure declared casually in one year sets the obligation in the next. Returns are best treated as a cumulative record of a compliance position, not as an annual form to be disposed of.
