MPCB Consent · Industrial & Manufacturing

MPCB Consent for Manufacturing Units, CTE, CTO and renewal

For a manufacturing unit the MPCB consent is the licence to run, Consent to Establish before construction, Consent to Operate before production, and a renewal cycle whose length is set by the category the unit is assigned.

Screening view on your project, with the category and route named. No obligation.

What this means for industrial & manufacturing

Consent is granted under section 25 of the Water Act 1974 and section 21 of the Air Act 1981, and for a manufacturing unit it fixes the whole operating envelope: products and installed capacity, raw materials, water drawn and effluent discharged, the air emission sources including process stacks and DG sets, the hazardous waste streams generated, and the disposal route for each. The unit's classification as Red, Orange, Green or White under the CPCB pollution-index system follows from that activity and drives real consequences: it sets how long a Consent to Operate runs before it must be renewed, how closely the unit is monitored, and in the White category whether consent is required at all as against an intimation. In an MIDC estate a further layer applies: the effluent leaving the premises usually goes to a common effluent treatment plant, so consent conditions bind the unit to CETP inlet norms and to the metering and membership arrangement the estate operates, rather than to a discharge standard at a river outfall.

How KIPL runs it

KIPL prepares the consent as a description of the unit that will still be true in three years. That means capacity declared at the level the unit intends to reach rather than at today's utilisation, product mix stated broadly enough that a new variant is not an unconsented activity, DG sets included with their stack heights, and hazardous waste streams listed with quantities and routes that match the authorisation. We handle CTE before civil work starts, CTO before commissioning, amendments when capacity, product or equipment changes, and renewal ahead of expiry with the monitoring data and Form-V position already in order. What goes wrong is nearly always one of three things: production quietly exceeding consented capacity, a new product or process line added without amendment, or a renewal filed late with a monitoring record that has gaps in it: each of which turns an administrative task into a show-cause.

  • s.25 / s.21

    No consent, no production

Consent to Establish precedes construction and Consent to Operate precedes production, under the Water Act 1974 and the Air Act 1981. Operating outside a valid consent is an offence in itself.

  • Red / Orange

    Category sets the renewal clock

The CPCB pollution-index category assigned to the activity governs consent validity, fee and monitoring intensity, so the classification decides how often the unit is back before the Board.

  • CETP

    Estate arrangements bind the consent

In MIDC estates, effluent goes to a common plant and consent conditions attach to CETP inlet norms, metering and membership rather than to a direct discharge standard.

What you receive

Written for industrial & manufacturing, not adapted from a template.

  • 01CTE and CTO applications with product-wise installed capacity, raw materials, and a water balance that reconciles intake to discharge
  • 02Air emission inventory covering process stacks, furnaces or ovens, fume extraction and DG sets with stack heights and control equipment
  • 03Effluent characterisation and declared route, CETP inlet with metering, or treated discharge or reuse where the unit is outside an estate
  • 04Hazardous waste stream schedule aligned to the Hazardous and Other Wastes Rules 2016 authorisation and to the disposal or co-processing route
  • 05Category assessment against the CPCB pollution index, with the resulting validity period and renewal date recorded
  • 06Amendment filings for capacity increase, new product line, modernisation or equipment change, and renewal filed ahead of expiry

Questions from industrial & manufacturing

What industrial & manufacturing ask before appointing us.

Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.

What decides whether our unit is Red, Orange, Green or White?

The activity, under the CPCB pollution-index classification adopted by the State Boards, not the size of the plant or how clean the housekeeping is. The category then sets consent validity, fees and monitoring expectations, with White-category activities requiring only intimation rather than consent. Because the category drives the renewal cycle, it is worth confirming at the CTE stage rather than discovering at renewal.

Do we need fresh consent for an expansion or a new product line?

Yes, before it is commissioned. An increase in installed capacity, a new product, a new process step or a significant equipment change alters the consented position and needs an amendment or a fresh consent. Units routinely add a line first and regularise later, and that sequence is exactly what an inspection finds, because production records will not match the consented capacity.

We discharge to the estate CETP. Does that reduce our obligations?

It changes them rather than reducing them. The unit still has to treat to the CETP inlet norms specified in its consent, meter what leaves the premises, maintain its own primary treatment where required, and hold its CETP membership current. Estates meter member discharge, so a unit sending more or stronger effluent than declared is visible from the estate's own records.

Are DG sets covered by the consent?

They are air emission sources and belong in the consent with their capacity, stack height and noise position, and they carry emission and noise standards under the Environment (Protection) Rules. Standby sets are frequently left out of applications because they run rarely, and they are then found running during a power outage on the day of an inspection.

How far ahead of expiry should renewal be filed?

Far enough that the supporting evidence can be assembled properly: current monitoring data, the Form-V environmental statement, hazardous waste records and the compliance position on existing conditions. Renewals are refused or delayed far more often for an incomplete evidence trail than for anything wrong with the plant, and a lapsed consent stops production regardless of the reason.

Should capacity be declared at current output or at design capacity?

At the installed capacity the unit will actually operate to, because consent is a ceiling. Declaring today's low utilisation makes the file look modest and then puts the unit in breach on the first good year. Over-declaration has its own cost in fees and category, so the honest answer is the realistic operating envelope over the consent's validity.
