CER Advisory for Manufacturing Units

Where a manufacturing expansion carried an Environment Clearance, the Corporate Environment Responsibility commitment in it is a spend with a fixed geography and an evidence trail: not a line item that can be absorbed into the company's CSR budget.

What this means for industrial & manufacturing

Corporate Environment Responsibility arises as a condition of the clearance under the MoEF&CC's office memorandum of 1 May 2018: an amount linked to the project's capital cost, spent on activities identified for the area around the project site, and reported through the half-yearly EC compliance mechanism. CSR under section 135 of the Companies Act 2013 is a different instrument entirely: profit-linked, governed by a board committee, spent on the activities in the Act's schedule anywhere the company chooses, and reported in the board's annual report. Manufacturing groups frequently run a mature CSR programme and assume it covers the CER condition, which it does not: the geography is fixed by the clearance, the reporting route is different, and the same rupee cannot discharge both. The condition also does not lapse with time, so an unspent commitment from an expansion cleared several years ago is still live when the unit next approaches the authority.

How KIPL runs it

KIPL takes the commitment from the clearance letter and delivers it as a documented programme: activities selected for the area the condition specifies and, where a public consultation was held, informed by what was actually raised there, then costed, scheduled, delivered with identified local counterparts, and evidenced with location, spend, beneficiaries and photographic record. We keep the CER ledger separate from the CSR ledger so no spend is claimed twice, and we format the progress record for the half-yearly compliance report so it can be read directly by the appraisal authority. The failure this addresses is straightforward and common in manufacturing: the clearance was obtained by a project team, the CER commitment went into the file with it, no budget line or owner was assigned at project closure, and the compliance report has restated the commitment ever since with nothing behind it.

    CER is a clearance condition

The MoEF&CC office memorandum on Corporate Environment Responsibility attaches a capital-cost-linked spend to activities around the project site, reported through EC compliance.

  • s.135

    CSR is a separate regime

CSR under the Companies Act 2013 is profit-linked with its own permitted activities, board committee and annual reporting. A single spend cannot discharge both obligations.

  • The commitment outlives the project team

CER is agreed at appraisal by whoever ran the clearance and then commonly orphaned at project closure, leaving a live condition with no owner and no budget line.

What you receive

Written for industrial & manufacturing, not adapted from a template.

  • 01CER commitment extracted from the clearance letter with the amount, activity heads and geography exactly as conditioned
  • 02Activity plan for the specified area, informed where applicable by issues raised during public consultation
  • 03Costing, schedule and identified local implementation counterparts for each activity
  • 04Separate CER and CSR ledgers with a documented rule preventing any spend being reported under both
  • 05Evidence pack per activity: location, spend against commitment, beneficiaries, photographs and completion record
  • 06CER progress section drafted for the half-yearly EC compliance report and for the next appraisal or amendment

Can our existing CSR programme discharge the CER condition?

No. CER is an EC condition with a geography fixed by the clearance and a reporting route through the compliance report; CSR is a profit-linked obligation under the Companies Act 2013 with its own permitted activities and board reporting. A company may deliver both through the same field team, but the activities, the ledgers and the reports have to be distinct, and the same spend cannot be claimed twice.

How is the CER amount determined?

It follows the MoEF&CC memorandum of 1 May 2018, which links the commitment to the project's capital cost, and it is then written into the clearance as a condition with the activities and the area. The operative figure for any unit is the one in its own clearance letter, so the first step is always to read the condition rather than to work from the general framework.

Where does the spend have to go?

To the area around the project site as identified in the clearance. That is the constraint most companies find inconvenient, because their CSR programme may be running somewhere else entirely, and it is exactly the constraint the condition intends. Activities drawn from what the surrounding area actually raised at public consultation are both easier to justify and more likely to be used.

Our expansion was cleared years ago and the CER is largely unspent. What now?

State the position accurately in the next compliance report with a dated, funded completion plan behind it. The commitment does not lapse, and it will be examined when the unit files any amendment or further expansion. An acknowledged shortfall with a schedule is a defensible position; several years of reports claiming progress with no evidence is not.

What evidence is required in the compliance report?

Activity, location, amount spent against the amount committed, timing, beneficiaries and photographic evidence of what exists on the ground. Recording it as the work is delivered is straightforward; assembling it two years later from memory and vouchers is not, and a narrative that repeats the commitment without figures is what draws a query.

Who should own CER inside a manufacturing company?

A named owner with a budget line, reporting alongside the person who owns the EC compliance report, often the plant head or an administration function rather than the process or EHS team, because delivery is community work rather than plant work. The critical moment is project closure: if ownership is not formally transferred from the project team then, it will not be assigned at all.
