CER Advisory for Distillery and Ethanol Projects
CER on a distillery clearance is directed at the villages that carry the odour and groundwater concern, because those are the settlements whose objections the public hearing recorded.
Screening view on your project, with the category and route named. No obligation.
What this means for distilleries & ethanol
Corporate Environment Responsibility is a condition of the clearance, set by the MoEF&CC's 2018 Office Memorandum as a proportion of project capital cost on a graded scale, and it has to be spent within the project's zone of influence. At a distillery that zone is not abstract. The public hearing record will name the villages that raised odour from the lagoons, anxiety about groundwater near spent wash storage, and concern about the effect on wells and on cattle. Those villages are the intended beneficiaries, and CER spent elsewhere does not discharge the condition however useful the activity. This is one of the few clearance conditions where the regulatory requirement and the plant's practical interest coincide exactly: the settlements that must receive the spend are the ones whose continuing objections determine how the plant is inspected and how the next expansion is received.
How KIPL runs it
KIPL scopes the CER programme against the hearing record itself rather than a template. Where the concern was groundwater, drinking water supply and independent water quality testing shared with the panchayat address it directly; where it was odour and health, health screening and primary care support; and school, sanitation and community infrastructure where the objection was broader. Activities are agreed with the district administration and the gram panchayats, delivered through the committed period, and documented as the half-yearly compliance report requires: sanctioned against actual expenditure, beneficiaries, locations, photographs and completion records. What goes wrong otherwise is a distillery that has spent its CER budget and still faces the same objection at its expansion hearing, because the money went where it was easy to spend rather than where the concern was.
- 2018 OM
CER is a percentage of capital cost
The MoEF&CC's 2018 Office Memorandum sets CER as a graded proportion of project capital cost, written into the clearance as a condition with a stated period.
- Hearing record
The objectors are the beneficiaries
The villages that raised odour and groundwater concerns at the public hearing are the settlements in the zone of influence the spend is meant to reach.
- Companies Act s135
CER is not CSR
Statutory CSR under section 135 and CER under the clearance are separate obligations, and the same expenditure cannot be reported against both.
What you receive
Written for distilleries & ethanol, not adapted from a template.
- 01CER budget computed against project capital cost on the basis set by the 2018 OM, as stated in the clearance condition
- 02Needs assessment across the villages in the zone of influence, mapped directly to the public hearing record
- 03Activity plan agreed with the district administration and gram panchayats, weighted to water and health where those were the concerns
- 04Implementation management through the committed period, including contractor and vendor oversight
- 05Expenditure, beneficiary, location and completion documentation for the half-yearly compliance report
- 06Community engagement record that can be produced at a later hearing for an expansion
Questions from distilleries & ethanol
What distilleries & ethanol ask before appointing us.
Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.
Ask a question →How is the CER amount for a distillery decided?
As a proportion of the project's capital cost on the graded scale in the MoEF&CC's 2018 Office Memorandum, with the applicable figure stated in the clearance condition itself. The clearance letter is the authority for the amount and the period over which it must be spent.
Where must the money be spent?
In the project's zone of influence (the study area assessed in the EIA, in most cases a ten kilometre radius) and in practice in the villages that appear in the public hearing record. Expenditure outside that area does not discharge the condition, whatever its merits.
What activities suit a distillery's CER?
Those that answer the objections raised. Odour and groundwater dominate distillery hearings, so drinking water supply, independent water quality testing shared with the panchayat, and health screening are the activities that address the stated concern. School, sanitation and community infrastructure follow where the objection was broader.
Can our CSR spending count as CER?
No. CSR under section 135 of the Companies Act and CER under the clearance are separate obligations with separate reporting, and the same expenditure cannot be shown against both. The two are compared when the reports are read together.
How does CER affect a future expansion hearing?
Considerably, because the same villages will attend it. A documented programme that visibly addressed the earlier concern changes the tone of a subsequent hearing; a budget spent on activities the community did not ask for leaves the original objection intact and available to be raised again.
What documentation is required?
Sanctioned versus actual expenditure, activity-wise locations and beneficiaries, photographs, completion certificates and panchayat acknowledgement where relevant, reported half-yearly against the CER condition. The records have to exist in a form an inspector can verify on the ground.
