CER Advisory for Chemical Projects
Corporate Environment Responsibility on a chemical clearance is a costed condition: a share of project capital cost, spent in the villages within the project's zone of influence, and evidenced in the half-yearly compliance report.
Screening view on your project, with the category and route named. No obligation.
What this means for chemical industry
The MoEF&CC's 2018 Office Memorandum on Corporate Environment Responsibility set CER as a proportion of project capital cost on a graded scale, higher for smaller projects and tapering as capital cost rises, and made it a condition of the clearance rather than a voluntary undertaking. For a chemical project the significance is where that money has to land. The zone of influence around the plant (the study area assessed in the EIA, usually a ten kilometre radius) contains the same settlements that appeared at the public hearing raising odour, effluent discharge and drinking water concerns. CER spent elsewhere, however worthy, does not answer those objections and does not discharge the condition.
How KIPL runs it
KIPL scopes CER against what the hearing actually surfaced, because a chemical project's social exposure is concentrated and specific. Drinking water infrastructure where groundwater quality is the fear, health screening where emissions are, school and community facilities in the villages nearest the boundary, chosen with the district administration and gram panchayats rather than assembled from a template. Delivery is then documented as the compliance report needs it: sanctioned amount against actual expenditure, beneficiary and location records, photographs and completion certificates. What goes wrong otherwise is a project that has spent the money and cannot prove it, or that spent it on activities the local community never asked for: which leaves both the condition unsatisfied and the original objection alive.
- 2018 OM
CER is a percentage of capital cost
The MoEF&CC's 2018 Office Memorandum sets CER as a graded proportion of project capital cost, written into the clearance as a condition with a defined activity list and period.
- Zone of influence
It has to land in the study area
CER is directed at the villages within the project's assessed study area, the same settlements that appear in the public hearing record: not at the company's preferred geography.
- Companies Act s135
CER is not CSR
Statutory CSR under section 135 of the Companies Act and CER under the clearance are separate obligations with separate governance, and the same expenditure cannot discharge both.
What you receive
Written for chemical industry, not adapted from a template.
- 01CER budget computed against project capital cost on the basis set by the 2018 OM, as written into the clearance condition
- 02Needs assessment across the villages in the study area, mapped to the concerns raised in the public hearing record
- 03Activity plan agreed with the district administration and gram panchayats, with location, beneficiary and timeline stated
- 04Implementation management through the committed period, including vendor and contractor oversight
- 05Expenditure, beneficiary and completion documentation in the form the half-yearly compliance report requires
- 06Reporting pack tying CER delivery to the specific clearance condition it discharges
Questions from chemical industry
What chemical industry ask before appointing us.
Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.
Ask a question →How much CER does a chemical project have to spend?
It is a proportion of the project's capital cost, set on the graded scale in the MoEF&CC's 2018 Office Memorandum (a higher percentage for smaller projects, tapering as capital cost increases) and the applicable figure is stated in the clearance condition itself. The clearance letter, not a general rule of thumb, is the authority for the amount.
Can our CSR spending count as CER?
No. CSR under section 135 of the Companies Act and CER under the Environment Clearance are separate obligations, governed differently and reported differently. The same expenditure cannot be shown against both, and attempting it is visible when the two reports are compared.
Where does the money have to be spent?
In the project's zone of influence (the study area assessed in the EIA, in most cases a ten kilometre radius) and preferably in the settlements that raised concerns at the public hearing. Expenditure outside that area does not discharge the condition even if the activity is valuable.
What kind of activities suit a chemical project?
Those that answer the concerns the hearing raised. Where the objection was groundwater quality, drinking water infrastructure; where it was emissions and health, screening camps and primary health support; where it was general disruption, school, sanitation and community facilities. The choice should follow the public hearing record, which is a document, not an impression.
How is CER evidenced for compliance?
Sanctioned versus actual expenditure, activity-wise location and beneficiary records, photographs, completion certificates and, where relevant, panchayat acknowledgement. This is reported in the half-yearly compliance report against the CER condition, so the records have to exist in a form an inspector can verify.
What if the community wants something outside the approved activity list?
The condition and the OM define the permissible scope, so the practical approach is to find the activity that both meets the community's stated need and sits within that scope. Where it genuinely cannot, the position to take is to raise it with the authority rather than to spend outside the condition and report it as compliance.
