Environment Clearance for Mining & Mineral Projects
Environment Clearance for a mining project is granted under item 1(a) of the EIA Notification 2006, where the lease area sets the category, adjoining leases are assessed as a cluster, and the public hearing is usually what decides how long the file takes.
Sector experience, not sector accreditation. KIPL has delivered work in this sector under an approved project coordinator. It is outside our QCI-NABET accredited scope, and we say so before any appointment.

What this means for mining & minerals
Item 1(a) is one of the few schedule entries where the size of the land, not the size of the plant, decides everything. A lease area of 50 hectares or more places most mineral projects in Category A before the MoEF&CC and its Expert Appraisal Committee; below that the file sits with the SEIAA. Minor minerals are not exempt: after the Supreme Court's direction in Deepak Kumar, even small sand ghats and murrum quarries need clearance, and contiguous leases within 500 metres are assessed together as a cluster on their aggregate area, which is how a set of individually small ghats becomes a single large appraisal. The study itself is unusually exposed: the mine plan approved by the Indian Bureau of Mines fixes the production and the pit geometry the EIA must assess, the baseline has to carry drilling, blasting and haul-road dust rather than stack emissions, and the public hearing is held in villages that will live with the trucks.
How KIPL runs it
KIPL has delivered EIA work on mining projects (GMDC's Goniasar and Naredi-Mota-Nandra bauxite leases, the Kawatha manganese mine and district sand ghats in Nagpur, Bhandara, Yavatmal and Beed) coordinated by Dr. Pramod Chaudhari, who is QCI-NABET approved as a Project Coordinator for mining projects. The organisation's own NABET accreditation covers sectors 5(f), 5(g), 5(j), 8(a) and 8(b) and does not cover item 1(a); mining assignments are undertaken on the coordinator-led basis described above, and we state that rather than imply a sector accreditation we do not hold. What goes wrong on mining files is nearly always one of three things: an EIA written to a production figure the approved mine plan does not support, a baseline that fails to characterise the haul route and the receptor villages along it, or a public hearing entered without a settled position on land, dust and employment: after which the commitments made in the hall become clearance conditions anyway, with no costing behind them.
- 1(a)
Lease area drives the category
The schedule categorises by mining lease area, so a boundary redrawn on the lease map can move a project between the SEIAA and the MoEF&CC, and cluster rules aggregate leases within 500 metres.
- MMDR 1957
The mine plan is the ceiling
The mine plan approved by the Indian Bureau of Mines fixes production, pit development and dump siting. An EC sought for anything the mine plan does not carry will not survive appraisal.
The public hearing is the hard gate
Mining hearings are contested on land, water, dust and haulage. Category A leases and most Category B leases cannot skip consultation, and the record of it is read at appraisal.

Questions from mining & minerals
What mining & minerals ask before appointing us.
Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.
Ask a question →Is KIPL NABET-accredited for mining EIA?
No. KIPL's QCI-NABET accreditation covers sectors 5(f), 5(g), 5(j), 8(a) and 8(b); item 1(a), mining of minerals, is not on the certificate. What KIPL has is delivered mining experience (EIA work on GMDC's Goniasar and Naredi-Mota-Nandra bauxite leases, the Kawatha manganese mine and district sand ghats) coordinated by Dr. Pramod Chaudhari, who is individually QCI-NABET approved as a Project Coordinator for mining projects. We describe that as experience and as a coordinator-led route, never as organisational sector accreditation, and the NABET badge is not shown on mining work.
Does a small sand ghat or minor mineral quarry need Environment Clearance?
Yes. Following the Supreme Court's direction in Deepak Kumar, minor minerals were brought into the clearance net regardless of how small the lease is, and the 2016 amendment to the EIA Notification set out how small leases are categorised. Contiguous leases within 500 metres are also assessed as a cluster on their combined area, so a district tendering several adjoining ghats can find itself with a much larger appraisal than any single ghat would attract.
What decides whether a mining project is Category A or B?
The mining lease area, as set out in item 1(a) of the schedule to the EIA Notification 2006: 50 hectares and above places most mineral projects in Category A, appraised centrally by the MoEF&CC through its Expert Appraisal Committee, and smaller leases go to the State Environment Impact Assessment Authority. The General Condition can override this: a lease within the prescribed distance of a protected area, a critically polluted area or an inter-state boundary is treated as Category A whatever its size.
Can the EIA be prepared before the mine plan is approved?
Baseline monitoring can start, but the assessment cannot be finalised. The mine plan approved by the Indian Bureau of Mines fixes the production rate, the year-wise pit development, the dump locations and the closure concept, all of which the EIA must assess and the EMP must mitigate. An EIA built on a production figure the approved plan does not carry is the most common reason a mining file is sent back.
How long does a mining Environment Clearance take?
It is driven by three things that are not in the consultant's control: the baseline season, which for most leases means at least one full non-monsoon quarter of monitoring; the appraisal committee's meeting calendar; and the scheduling of the public hearing by the State Pollution Control Board and the district administration. We do not quote a fixed turnaround for mining, because a contested hearing or a re-advertised hearing can add a quarter on its own.
What is usually the deciding issue at a mining public hearing?
Land and livelihood first, then water and dust. Villages along the haul route raise road damage and dust; villages near the pit raise blasting, wells drying and the loss of grazing or cultivation. Where habitation is affected the rehabilitation and resettlement position has to be settled before the hearing, not argued in it, because every commitment made in the hall is read back at appraisal and written into the clearance.
