Environment Clearance for Real Estate & Construction: the item 8(a) approval that gates the foundation.

A building project whose built-up area crosses the item 8(a) threshold of the EIA Notification 2006 cannot begin construction until the State Environment Impact Assessment Authority grants Environment Clearance, which places the clearance squarely on the RERA critical path.

What this means for real estate & construction

Item 8(a) of the schedule to the EIA Notification 2006 covers building and construction projects, and it is measured on built-up area rather than on plot size, plot value or number of units. A project above that threshold files Form-1 together with Form-1A (the form written specifically for the built environment, covering built-up area, water and power demand, parking, excavation, sewage and solid waste) and is appraised by the SEAC on behalf of the SEIAA. Splitting a single sanctioned layout into notional phases does not reset the calculation; the appraisal committee looks at the aggregate built-up area of the development as sanctioned. The grant arrives with conditions on construction-phase dust and C&D waste, on the sewage treatment plant to be built, on the water balance including treated-water reuse, and on plantation and pervious area: and the local body will look for the clearance before commencement, while the occupancy certificate stage will look for evidence that the conditions were met.

How KIPL runs it

KIPL prepares the 8(a) file so it reconciles to the drawings the planning authority has already sanctioned: the built-up area statement, the water balance, the STP capacity and the parking and traffic case are made to agree with each other and with the architect's plans before anything is uploaded to Parivesh. The failures we are usually called in to repair are the same three, a built-up area declared one way to the planning authority and another way in Form-1A, an STP sized to a brochure occupancy that the committee will not accept, and a project that filed after excavation had begun. Each of them costs a full appraisal cycle, and an appraisal cycle is measured in committee meetings, not in weeks.

  • 8(a)

Built-up area, not plot area, decides it

A building or construction project above the item 8(a) threshold of the EIA Notification 2006 needs Environment Clearance from the State authority before construction starts. The trigger is built-up area as sanctioned, which is why the architect's area statement and the environmental file must say the same thing.

  • RERA

The completion date is a sworn commitment

The completion period declared at RERA registration is a declaration to allottees, not an internal target. An unplanned appraisal cycle on the EC pushes the whole works programme, and relief under the Act is narrow.

  • EP Act 1986

Starting without the grant is not curable on the site

Construction commenced before the clearance is a violation under the Environment (Protection) Act 1986, and the route back is a separate and far slower process than filing correctly in the first place.

What you receive

Written for real estate & construction, not adapted from a template.

  • 01Built-up area screening against item 8(a), reconciled to the sanctioned area statement
  • 02Form-1 and Form-1A for the building project, with the developer's water, power, parking and waste figures
  • 03Construction-phase and occupancy-phase water balance, including treated-water reuse for flushing and landscape
  • 04STP capacity, solid waste and C&D waste management proposals sized to design occupancy
  • 05SEAC presentation, query replies and the SEIAA grant on Parivesh
  • 06EC conditions translated into a works-programme matrix the project team and the RERA schedule can both hold

Does my residential building need Environment Clearance, or only a township does?

Both routes exist. An individual building or construction project above the item 8(a) threshold needs Environment Clearance in its own right; townships and area development are appraised separately under item 8(b). The screening is done on built-up area against the schedule to the EIA Notification 2006, so it is settled from the sanctioned area statement, not from the project's marketing description.

Can I start excavation while the EC application is pending?

No. For a project that falls under item 8(a), construction activity before the grant is a violation under the Environment (Protection) Act 1986, and site clearance and excavation are treated as construction. Enabling work that is genuinely outside the scope of the notified activity should be confirmed in writing before it starts, not assumed.

Will phasing the project keep it below the 8(a) threshold?

Not if the phases belong to one development on one sanctioned layout. The appraisal committee assesses the aggregate built-up area of the project as sanctioned, and a phased declaration that does not match the planning approval invites a category challenge. Phasing is a construction strategy; it is not a screening strategy.

How long does an 8(a) clearance take in Maharashtra?

It depends on the completeness of the file, whether the SEAC raises queries, and the committee's meeting calendar: the appraisal is scheduled around meetings, so a single query round can add a cycle. We map the route and the likely query set before filing so the launch plan is built on the real sequence rather than a hoped-for one.

Does the EC or the commencement certificate come first?

In practice the environmental clearance has to be in hand before construction begins, and planning authorities look for it as part of the pre-commencement paperwork. Sequencing the EC application against the plan sanction timeline is the single most useful thing a developer can do early, because the two calendars are independent and only one of them is negotiable.

What happens to the EC conditions after the building is occupied?

They survive. The STP performance, treated-water reuse, wet-waste processing, plantation and monitoring commitments continue as live obligations, reported half-yearly, and they are what the authorities examine at occupancy stage and on any subsequent inspection. A clearance is the start of a compliance record, not the end of a file.

Tell us the project, and we will tell you the category and the route.

Screening is the cheapest stage to get right and the most expensive to get wrong. We will say plainly what environment clearance your real estate & construction project needs, and what it does not.
