Wildlife Clearance for Mining Leases near Protected Areas

For a mineral lease inside a notified eco-sensitive zone or close to a protected area, the first question is not how the impact will be mitigated but whether mining is permitted there at all. And only after that does the State and National Board for Wildlife route begin.

Sector experience, not sector accreditation. KIPL has delivered work in this sector under an approved project coordinator. It is outside our QCI-NABET accredited scope, and we say so before any appointment.

What this means for mining & minerals

Eco-sensitive zone notifications around national parks and wildlife sanctuaries list activities as prohibited, regulated or permitted, and commercial mining sits on the prohibited list in most of them. That makes the ESZ check the first piece of work on any lease near a protected area, because a proposal for a prohibited activity is not a difficult application, it is a dead one, and the sooner a proponent knows the better. Where the lease lies outside the ESZ but within the distance that triggers wildlife scrutiny, the route runs through the State Board for Wildlife, which examines the proposal with the Chief Wildlife Warden's inputs, and then to the Standing Committee of the National Board for Wildlife, usually after a site inspection. A wildlife conservation plan drawn up with the territorial and wildlife divisions and funded by the user agency accompanies the proposal. The EIA Notification's General Condition compounds all of this: a lease within the prescribed distance of a protected area is treated as Category A regardless of its size, so a small quarry near a sanctuary is appraised centrally by the MoEF&CC. For mining the substantive issues are specific: blasting noise and vibration in a corridor, haul traffic crossing an animal movement route, night lighting, dust deposition on foraging habitat, and the fragmentation a linear haul road causes even when the pit itself is small.

How KIPL runs it

KIPL starts with the map: the lease boundary set against the notified ESZ boundary and the protected area boundary, the distance established from the correct reference rather than from an approximation, and the position stated to the proponent before any expenditure is committed. Where the proposal is viable, we prepare the SBWL and NBWL submission with the conservation plan built around what the mine actually does to wildlife (blast timing, haul road alignment and crossings, lighting design, a no-work buffer where a corridor is crossed), rather than a generic list of species-protection measures. This is experience-led work: KIPL's QCI-NABET accreditation covers sectors 5(f), 5(g), 5(j), 8(a) and 8(b), not item 1(a) mining, and mining assignments are coordinated by a QCI-NABET approved mining Project Coordinator. What goes wrong is starting with the EIA and discovering the wildlife position afterwards, a full baseline season spent on a lease that the ESZ notification never permitted.

  • ESZ

Mining is prohibited in most eco-sensitive zones

ESZ notifications classify activities as prohibited, regulated or permitted, and commercial mining is generally prohibited. The status check settles viability before anything else is spent.

  • NBWL

    SBWL then the Standing Committee

Proposals near protected areas move through the State Board for Wildlife to the Standing Committee of the National Board for Wildlife, normally with a site inspection.

  • General Condition

    Proximity escalates the category

A lease within the prescribed distance of a protected area is treated as Category A under the EIA Notification whatever its area, moving appraisal from the SEIAA to the MoEF&CC.

Ask a question →
Is KIPL accredited for mining?

No. KIPL's QCI-NABET accreditation covers sectors 5(f), 5(g), 5(j), 8(a) and 8(b); item 1(a) mining is not on the certificate. Wildlife clearance is in any case a separate statutory route under the Wildlife (Protection) Act 1972 to which NABET accreditation does not attach. On mining KIPL works from delivered project experience (GMDC's bauxite leases, the Kawatha manganese mine and district sand ghats) coordinated by Dr. Pramod Chaudhari, QCI-NABET approved as a Project Coordinator for mining projects.

Can a mine operate inside an eco-sensitive zone?

Generally not. Most eco-sensitive zone notifications list commercial mining among the prohibited activities, which means no clearance route exists for it inside that zone: the answer is a boundary question, not a mitigation question. This is why the ESZ status of a lease should be established before baseline monitoring, land acquisition or any other commitment.

How far from a sanctuary does wildlife clearance apply?

Where a notified eco-sensitive zone exists, its notified boundary governs. Where one does not, proposals near a national park or sanctuary are referred through the State Board for Wildlife to the Standing Committee of the National Board for Wildlife, and the EIA Notification's General Condition separately escalates a project within the prescribed distance of a protected area to Category A. Both questions have to be answered against the actual notification for that protected area rather than a rule of thumb.

What is a wildlife conservation plan and who pays for it?

It is a site-specific plan, prepared with the territorial and wildlife forest divisions and approved by the Chief Wildlife Warden, setting out habitat protection, corridor and mitigation measures for the area affected. It is funded by the user agency, the proponent: and its cost is a project line, so it needs to be estimated at proposal stage rather than after the Standing Committee's recommendation.

How long does the NBWL route add to a mining approval?

It depends on two things outside the proponent's control: the State Board for Wildlife's meeting cycle and the scheduling of the site inspection that the Standing Committee usually calls for. We do not quote a fixed period for mining wildlife proposals, and we plan the Environment Clearance sequence so that baseline work is not stranded while the wildlife position is settled.

Which mining impacts does the wildlife committee focus on?

Fragmentation and disturbance more than emissions. A haul road cutting an animal movement corridor, blasting noise and vibration in a breeding or foraging area, night lighting and traffic, and dust deposition on vegetation are the recurring concerns. The conservation plan is judged on whether it addresses those specifically, with crossings, timing restrictions and buffers, rather than by its length.
