Environment Clearance for Ports, Terminals & Logistics Parks

Ports and harbours are appraised under item 7(e) of the EIA Notification 2006 on cargo capacity, while the land-side logistics park or warehousing platform behind them is appraised under items 8(a) and 8(b) on built-up area: two different filings that the same project often needs.

What this means for logistics & ports

The logistics chain crosses two entirely different parts of the schedule, and proponents regularly discover this late. A port or harbour falls under item 7(e), where cargo handling capacity sets the category (larger capacities are appraised centrally by the MoEF&CC through its infrastructure Expert Appraisal Committee, smaller ones by the State authority) and the assessment is dominated by marine questions: capital dredging volume and where the spoil goes, sediment transport and shoreline change, the marine ecology baseline, cargo dust where the terminal handles dry bulk, oil spill risk, and the road and rail loading that the evacuation corridor has to absorb. A warehousing platform, logistics park, container freight station or inland container depot is a different animal altogether, assessed under item 8(a) on built-up area or item 8(b) as an area development project, where the questions are water demand and sewage, stormwater across an enormous impervious roof and pavement area, solid and hazardous waste, traffic generation at the gate and along the last mile, and the green belt. Large integrated projects need both, plus CRZ clearance where any part of the site is coastal.

How KIPL runs it

KIPL takes the land-side filings under items 8(a) and 8(b) as a QCI-NABET accredited organisation, these are sectors on the certificate, and prepares the coastal and marine components alongside them so a project with a jetty at one end and a warehouse platform at the other is presented as one coherent case rather than two files that disagree on the site area. The judgment that matters at the start is scoping: whether the project is one application or several, whether phased development can be assessed as a whole, and whether the built-up area calculation is being done on the right basis, because the difference between 8(a) and 8(b) changes the study and the authority. Coastal experience carries the marine side, with mandates including Allcargo Logistics on the land-side and the Chowgule Lavgan shiprepair facility on the waterfront. The recurring failure is a warehousing platform built in phases, each phase kept just under the threshold on paper, until the aggregate built-up area is assessed as a single project and the whole development is found to have been constructed without clearance.

  • 7(e)

Ports and harbours by cargo capacity

Cargo handling capacity places a port or harbour in Category A or B, with the assessment turning on dredging, marine ecology, cargo dust and the evacuation corridor.

  • 8(a) / 8(b)

The land-side platform by built-up area

Warehousing, logistics parks, container freight stations and inland container depots are assessed as building or area-development projects on built-up area and site extent.

  • Phasing does not avoid the threshold

Development split into phases to keep each below a limit is assessed on the aggregate. This is the commonest way a large logistics platform ends up operating without a valid clearance.

What you receive

Written for logistics & ports, not adapted from a template.

  • 01Screening across items 7(e), 8(a) and 8(b), with a written position on single versus phased application
  • 02Form-1, Form-1A where applicable, and Pre-feasibility Report for the correct schedule entry
  • 03Marine baseline, dredging and disposal assessment, and shoreline change study for the waterfront component
  • 04Cargo dust and emissions assessment for dry bulk handling, with the receptor settlements identified
  • 05Traffic generation and evacuation corridor assessment for the gate and the last mile
  • 06EIA, EMP and appraisal support to the EAC or SEIAA, run alongside the CRZ file where applicable

Which schedule entry covers a logistics park: 7(e) or 8(a)?

Item 7(e) covers ports and harbours; a land-side logistics park, warehousing platform or container freight station is assessed as a building and construction project under item 8(a) on built-up area, or as an area development project under item 8(b) where the site extent or built-up area is larger. An integrated project with a terminal and a land-side platform can require both, and getting this wrong at Form-1 stage sends the file to the wrong committee.

Is KIPL accredited for the sectors these projects fall under?

For the land-side platform, yes, KIPL's QCI-NABET accreditation covers sectors 8(a) building and construction and 8(b) townships and area development, which is what a warehousing park, logistics platform or container freight station is assessed under. Accreditation is public and per-sector, so it is worth confirming any consultant's scope against the register before a file is opened.

Does a warehousing project below the built-up area threshold need EC?

Not under item 8(a) if it genuinely falls below the threshold, but the calculation has to be done correctly and on the whole development rather than on one shed. Where a platform is built in phases on a single parcel under common control, the aggregate is what counts. It will still need consents, and if any part of the site is within the Coastal Regulation Zone, CRZ clearance applies regardless of built-up area.

What dominates the appraisal of a port project?

Dredging and its disposal, first: the volume, the character of the material, the disposal location and the turbidity it will create. Then shoreline change and sediment transport, the marine ecology baseline, cargo dust where dry bulk is handled, oil spill risk and response capability, and the traffic the evacuation corridor has to carry. A port EIA that is strong on the terminal and thin on the corridor tends to be sent back on the corridor.

Can maintenance dredging be carried out under the existing clearance?

Ordinarily maintenance dredging to the approved depth is covered by the project's existing clearance and its conditions, including the approved disposal location and the monitoring regime. Capital dredging, deepening beyond the approved depth or extending the dredged area: is a change in the project that requires assessment and amendment, and treating it as maintenance is a condition breach that surfaces in the compliance record.

How long does a port or logistics EC take?

It is set by the baseline season, the appraisal committee's calendar and, where consultation applies, the scheduling of the public hearing. For a coastal project the CRZ file runs alongside, and the marine baseline usually governs the critical path. We do not quote a fixed period, because a project needing a full marine season plus a hearing is on a different timescale to an inland warehousing platform.
