MPCB Consent · Real Estate & Construction

MPCB Consent for Real Estate & Construction: Consent to Establish for the site, Consent to Operate for occupancy.

A development needs Consent to Establish from the Maharashtra Pollution Control Board before construction and Consent to Operate before the building is occupied, and both are categorised on what the project actually discharges and emits: its sewage treatment plant and its DG sets.

Screening view on your project, with the category and route named. No obligation.

What this means for real estate & construction

Consent under section 25/26 of the Water (Prevention and Control of Pollution) Act 1974 and section 21 of the Air (Prevention and Control of Pollution) Act 1981 is a separate approval from the Environment Clearance and is not delivered by it. For a building project, MPCB's view of the development is unglamorous and specific: how much sewage the occupancy will generate and how it will be treated, what the treated effluent will meet and where it will go, what the standby DG capacity is and how its stack and enclosure are configured, how construction-phase debris and wash water are handled, and what storage of diesel and other materials sits on site. Those parameters drive the consent category and the fee, and they are what the inspecting officer checks. The Consent to Operate is the one that matters commercially, because a building being handed over without a valid CTO position is a building with an unresolved compliance question at exactly the moment flats are being registered.

How KIPL runs it

KIPL prepares the consent application from the same technical basis as the clearance file, so the STP capacity, the effluent standards and the DG rating in the consent match the EC conditions rather than contradicting them. The recurring failure in this sector is a consent obtained early on design assumptions and never revised when the tower count, the basement count or the DG rating changed during execution: the mismatch surfaces at renewal or at occupancy inspection, when it is slowest to fix. We keep the consent aligned to the as-built project, file the amendment when the design moves, and hold the renewal calendar so the CTO does not lapse mid-handover.

  • Water Act 1974

    Sewage is the whole conversation

For a residential or commercial development, consent is written around the sewage treatment plant: its capacity, its treated-effluent quality and the reuse or discharge route. Get the sizing wrong and both the consent and the EC condition are wrong together.

  • Air Act 1981

    DG sets and construction dust

Standby DG capacity, stack height and acoustic enclosure bring the project under the Air Act, and construction-phase dust control is a live condition on the consent for as long as the site is active.

  • Occupancy needs the operating consent

Consent to Establish covers the construction stage; handover and occupancy sit on Consent to Operate. A CTO that has not kept pace with the as-built STP and DG capacity is a problem discovered at the worst possible time.

What you receive

Written for real estate & construction, not adapted from a template.

  • 01Consent to Establish application covering construction-phase discharges, debris and dust control
  • 02Consent to Operate application built on the as-built STP capacity, DG rating and design occupancy
  • 03Effluent and emission characterisation matched to the EC conditions for the same project
  • 04Amendment applications when tower count, basement count, STP capacity or DG rating change during execution
  • 05Renewal calendar and Form-V environmental statement filings for the operating asset
  • 06Inspection support and closure of MPCB observations at site

Ask a question →
Do I need MPCB consent if I already have Environment Clearance?

Yes. The Environment Clearance is granted under the EIA Notification 2006 and the consent is granted under the Water Act 1974 and Air Act 1981: different statutes, different authorities, different conditions. The clearance does not substitute for consent, and a project holding one but not the other is only half approved.

At what stage does a developer apply for Consent to Establish?

Before construction begins, alongside the other pre-commencement approvals, because the CTE covers the construction phase itself: its discharges, its debris and its dust. Applying late means either a stalled start or an active site running without the consent that authorises it.

What decides the consent category for a housing project?

In practice, the effluent load and the emission sources: the sewage treatment plant capacity and the treated-effluent route, and the standby DG capacity. The scale of these determines how MPCB categorises the project and what the consent fee and conditions look like, which is why the STP sizing exercise and the consent application should be done together.

Our tower count changed after we got the consent. Does that matter?

Yes, and it is the most common defect we see. Consent is granted against a declared configuration; if occupancy, STP capacity or DG rating has moved, the consent has to be amended. Left alone, the mismatch surfaces at renewal or at an occupancy-stage inspection, when correcting it delays handover.

Can we hand over flats before Consent to Operate is in place?

Occupancy without a valid operating consent leaves the project exposed at precisely the point where buyers are taking possession and the building is being registered. The practical answer is to sequence the CTO with the occupancy certificate application, which requires the STP to be commissioned and performing, not merely built.

Who holds the consent once the society is formed?

The obligation follows the operating entity. On handover to a co-operative housing society or apartment association, the consent, its renewal calendar and its conditions have to be transferred and the society made aware of what it now owns. Developers who skip this step leave the society with a lapsed consent and no record of why.
