Consent Renewal: keeping an MPCB consent live before it expires, not after.
An MPCB consent is granted for a fixed term, and renewal is decided on the compliance record of the term that is ending: which is why it is prepared well before the expiry date, not on it.
What it is
Consent to Operate under the Water Act 1974 and the Air Act 1981 is time-bound. Renewal is not automatic: the Board reconsiders the unit against its consented conditions, its monitoring returns, any directions or show-cause notices issued during the term, and any change in capacity, product mix or category since the last grant. Where a unit has expanded, changed process, or moved category, renewal becomes a fresh appraisal rather than a continuation.
KIPL treats renewal as a compliance exercise first and an application second. We reconstruct the term that is closing (analysis reports, returns filed, waste manifests, action taken on any notices) and reconcile the operating reality against the consent on record before the file goes in. Units that apply late, or that apply on the old capacity while operating at a new one, are the ones that end up operating without valid consent, which is legally the same position as never having had one.

Straight answers
Consent Renewal: common questions.
01When should an MPCB consent renewal be filed?
Well before the expiry date printed on the consent order. The Board expects the renewal application to be made in advance so that scrutiny and any site inspection can be completed while the existing consent is still running. Filing at or after expiry leaves the unit operating without valid consent during the gap.
02Is renewal automatic if nothing has changed?
No. The Board reviews the compliance record of the expiring term: monitoring returns, analysis results, any directions or notices, and site verification where it chooses. A clean record makes renewal straightforward, but it is still a decision the Board takes, not a formality that follows from an application.
03What happens if a unit operates after its consent has expired?
It is operating without consent, which is an offence under the Water and Air Acts regardless of whether a renewal application is pending. The Board can issue directions, including closure and disconnection of water and power supply. Expired consent also surfaces immediately in lender, insurer and acquirer diligence.
04Does a capacity increase change the renewal?
Substantially. If capacity, product mix or process has changed since the last grant, the renewal is appraised on the new configuration, the effluent and emission basis must be revised, and the applicable fee slab may shift. Where the change crosses an EIA Notification threshold or moves the unit into a higher pollution category, further approvals may be needed before renewal can be granted.
05Can category change between one consent and the next?
Yes. The CPCB Red, Orange, Green and White categorisation is periodically revised, and a change in process or product can move a unit between categories on its own. Category governs validity period, fee, the level within MPCB that decides the file, and in some cases the applicability of siting restrictions, so it should be re-checked at each renewal rather than assumed.
06What documents does a renewal application need?
The expiring consent and its conditions, recent effluent, emission and ambient monitoring reports from a recognised laboratory, water consumption and discharge records, hazardous waste manifests and returns, evidence of compliance with any specific conditions or bank guarantee commitments, and updated capacity and process details. Gaps in this record are what generate queries.
07Are CTE and CTO renewed the same way?
They are different in nature. CTE covers a construction window and is extended or amended when a project timeline slips, whereas CTO is a recurring operating permission that is renewed for successive terms across the working life of the unit. Most renewal activity at an operating site is CTO renewal.

MPCB Consent on the ground.

Consent Renewal is one stage of one practice. Most projects need several, and the commitments made at clearance are the ones we build and maintain.
Who we do this for
MPCB Consent reads differently by industry.
- 01
Real Estate & ConstructionCore
Construction needs Consent to Establish and occupancy needs Consent to Operate; the STP and DG sets are what MPCB actually categorises.
MPCB Consent for Real Estate & Construction - 02
Townships & Area DevelopmentCore
Each phase needs its own CTE and CTO position, tied to the STP, water-supply and waste infrastructure actually commissioned in that phase.
MPCB Consent for Townships & Area Development - 03
Data Centres & IT ParksCore
DG capacity, HSD storage and cooling-tower blowdown are what set the consent category and the conditions MPCB attaches to operation.
MPCB Consent for Data Centres & IT Parks - 04
Hospitality, Healthcare & EducationCore
Healthcare occupancies sit in a higher consent category because of bio-medical waste and effluent, which changes both fees and conditions.
MPCB Consent for Hospitality, Healthcare & Education - 05
Chemical IndustryCore
A Red-category chemical unit's CTE and CTO conditions are written around effluent load, solvent handling and hazardous-waste storage.
MPCB Consent for Chemical Industry - 06
Distilleries & EthanolCore
Distilleries are Red category with consent conditions written around spent wash volume, storage lagoons and boiler emissions.
MPCB Consent for Distilleries & Ethanol - 07
Sugar IndustryCore
A mill's consent has to cover the crushing season load, bagasse-fired boiler emissions and press mud handling as one integrated position.
MPCB Consent for Sugar Industry - 08
Industrial & ManufacturingCore
Consent to Establish, Operate and renew is the licence to run, and the Red/Orange/Green/White category decides validity period and fees.
