Environmental Legal Register: the list of laws that actually apply to your site.
An environmental legal register is the documented list of the environmental laws, rules and permit conditions that apply to a specific site, with what each one actually requires of it.
What it is
Applicability is not a matter of opinion. Whether the Hazardous and Other Wastes Rules 2016 apply turns on the waste streams a process generates; whether the Manufacture, Storage and Import of Hazardous Chemical Rules 1989 apply turns on chemicals held against threshold quantities; whether an Environment Clearance condition binds you turns on what the clearance letter says. A legal register records those determinations: statute, provision, why it applies, what it requires, and where the evidence of compliance sits.
KIPL prepares the register from the site rather than from a checklist: process flow, raw materials, chemical inventory, waste streams, discharge and emission points, siting, and the consents and clearances already held. Provisions that do not apply are recorded as considered and excluded, with the reason: which is often the more useful half, because it is what protects a site from being asked, later, why an obligation was ignored.

Straight answers
Environmental Legal Register: common questions.
01What is an environmental legal register?
It is a documented list of the environmental legal requirements applicable to a specific site (Acts, Rules, notifications, standards and the conditions in its own consents and clearances) with a plain statement of what each requires and how compliance is demonstrated. It is the applicability baseline everything else in a compliance system is built on.
02Is a legal register a statutory requirement?
No Indian environmental statute mandates the register itself. It becomes mandatory in practice through ISO 14001:2015, which requires an organisation to determine and maintain its compliance obligations under clause 6.1.3, and through lenders and auditors who ask an organisation to demonstrate that it knows what applies to it. The obligations are statutory; the register is how you prove you have identified them.
03How is it different from a compliance calendar?
The register establishes what applies and what it requires. The calendar schedules the dated actions that flow from it. One is a determination, the other is an operating plan. Building a calendar without the register underneath it is the common shortcut, and it tends to capture only the obligations someone already remembered.
04What decides whether a rule applies to a site?
Activity and thresholds, mostly. Waste rules apply by waste stream and category; chemical rules apply by substance and quantity held against Schedule thresholds; consent categories apply by industry classification; clearance conditions apply because they are written into the letter granted to that project. Applicability is determined against the site as it actually operates, not as it was designed.
05How often should the register be updated?
On two triggers rather than a fixed interval: whenever the law changes, amendments to waste rules and producer-responsibility regimes have been frequent: and whenever the site changes, meaning new products, new chemicals, capacity expansion, a new waste stream or a fresh consent. A yearly formal review with event-driven updates in between is the workable discipline.
06Who should prepare and approve it?
Preparation needs someone who can read both the statute and the process, which is why it is commonly outsourced to an environmental consultancy: but approval should sit with the site occupier or the EHS head, because the register records determinations that person will be answerable for. An unsigned register carries no weight in an audit.
07Does the register cover health and safety law too?
It can, and for most Indian sites it is more useful when it does, because environment, occupational safety and factory law overlap heavily in practice. Where a combined EHS register is prepared, the safety limb is being reworked as the Occupational Safety, Health and Working Conditions Code 2020 replaces the Factories Act 1948 and state rules under it are notified, so the safety entries need closer review than the environmental ones at present.
