Post-EC Compliance Regularisation for Funded Assets
A stalled asset usually carries years of unfiled half-yearly compliance reports, and regularising that record is a precondition to restarting construction rather than a housekeeping task for later.
Screening view on your project, with the category and route named. No obligation.
What this means for environmental & social due diligence
The half-yearly compliance report is a standing obligation under an Environment Clearance: a periodic statement to the regional office of the ministry, and on the portal, of how the project is performing against each condition of its clearance. When a project stalls, the reporting almost always stops, because the team that filed it is gone. What a fund inherits is therefore not only an unfinished building but a compliance record with a multi-year hole in it, and that hole is visible to any authority that looks, to a buyer at exit, and to the fund's own investors if the standard applied to the transaction requires disclosure of non-compliance.
How KIPL runs it
KIPL reconstructs the record (establishing what the conditions actually require, what the site can evidence for the dormant period, and what has to be stated honestly as not complied with) and files to bring the asset current. The temptation on this work is to file a benign report covering the gap; that is a worse position than a truthful one, because a compliance report that cannot be supported at inspection converts an administrative lapse into a misstatement. Restarting construction on an asset whose clearance conditions have not been reported against for years is also the point at which an inspection is most likely, which is the practical reason the regularisation goes before the mobilisation, not after it.
- EC condition
Half-yearly reporting is a standing obligation
Clearance conditions require periodic compliance reports to the regional office and on the portal, and the obligation continues whether or not work is proceeding.
A stall breaks the reporting chain
When a project stops, the team that filed the reports disperses, and the gap is discovered by the incoming sponsor rather than the outgoing one.
Restart attracts attention
Recommencing construction on a long-dormant asset is precisely when the authority, the local body and neighbours look at the project again.

Questions from environmental & social due diligence
What environmental & social due diligence ask before appointing us.
Answered against the regulation as it stands, not as a sales pitch. If your situation is not here, ask us directly.
Ask a question →What is the half-yearly compliance report?
A periodic report required as a condition of an Environment Clearance, stating the project's compliance against each clearance condition and submitted to the regional office of the ministry and uploaded as required. The cycle is half-yearly and the obligation runs with the clearance rather than with the construction activity.
Does the obligation continue while a project is stalled?
The clearance and its conditions remain in force, so the reporting obligation is not suspended because work has stopped. A dormant project generally has little activity to report, but a report stating that is a materially different record from silence.
Can we simply file the missing reports now?
Reports can be filed to bring the record current, and doing so is normally the right course. What they must not do is assert compliance that cannot be evidenced for the dormant period, since an unsupportable report is worse than an acknowledged gap and converts a lapse into a misstatement.
Will regularising the record trigger enforcement?
Bringing a record current draws attention to the gap, which is why it should be done deliberately with the position understood, and preferably before restart rather than after an inspection. In practice the alternative, restarting construction on an asset with a multi-year reporting gap: carries the greater exposure.
Why does this matter to a fund rather than to the developer?
Because the fund is deploying capital into an asset whose ability to complete depends on its regulatory standing, and because at exit a buyer's adviser will examine exactly this record. An asset with a current compliance record and a documented remediation of the gap is a cleaner sale than one where the gap is still open.
How long does regularisation take?
It depends on how many cycles are missing, how much site evidence survives from the dormant period, and whether corrective actions are needed before conditions can be reported as complied with. The reconstruction of evidence, not the filing, is normally what sets the timeline.
